These Terms of Use set forth the terms and conditions under which BRUSA TV will agree to provide or otherwise make available our Services. Your access and use are conditioned upon your acceptance of these Terms of Use and are effective until we change or replace them.

BRUSA TV. Devices.

A.Not all devices are compatible or permitted for use with our Services. B. If you fail to make timely payment for your Services, we may disconnect, suspend, limit or terminate your access to these Services, in which case we will be promptly and forever discharged of any and all obligations and obligations. Unless required by applicable law, deposits will not be kept segregated from other funds and will not earn or accrue interest. The promotional price is valid only at the time of the initial purchase of such Promotional Subscription Service or Transactional Service, and we reserve the right to stop any promotion at any time for any reason. Attorney Fees / Collections. If we use a solicitor or collection agency to collect any money you owe us or to assert any other right we may have against you (for example, any breach of any contract you may have with Brusa TV or any of our affiliates), then you agree to pay the reasonable costs of such collection or other action. These costs may include the costs of a collection agency, reasonable attorneys' fees, and court costs. If you believe you have been billed in error, you should contact our Customer Service immediately and in no case more than 15 days after the date you receive an account for which you are seeking correction. Failure to give timely notice of any dispute will constitute your acceptance of the corresponding invoiced amounts. You must pay undisputed portions of any billing statement when due, or without limitation, to any other rights or remedies available to Brusa TV in law, in equity, under contract (including these Terms of Use), or otherwise, all of which are hereby expressly reserved (for example, we may choose to suspend or terminate your Subscription Services or any of our Services), either permanently or temporarily, in whole or in part. All payments for our Services must be made directly by you to us, unless otherwise authorized; and unless otherwise authorized, Brusa TV shall have no obligation to provide services for which payment is made by a third party or for which payment is made by a third party on its behalf.

 

Section 6: CUSTOMER SUPPORT SERVICES AND RELATED COMMUNICATIONS

A. Customer Service. Brusa TV may choose to provide Member Account support services or other assistance in connection with your Member Account ("Customer Service"). The levels, methods and availability of our Customer Service offered are determined by us, in its sole and absolute discretion; we are under no obligation to provide any Customer Service in connection with our Services. If we make available or offer services to Customer, such Customer Services are deemed to be part of our Services for the purposes of these Terms of Use, including any and all restrictions, exemptions and limitations contained herein.

B. Communications. By registering for a Member Account, you agree to receive electronic communications from us and other Contributors relating to that account and our Services. These communications may involve sending e-mails to the e-mail address that you provided during registration or delivery of electronic communications through your Member Account, and will include notices about your Member Account (for example, payment, payment method changes or changes, confirmation e-mails, notices, and other similar or transactional information related to that account); these communications are part of our Services and your relationship with us. You agree that any notice, agreement, disclosure or other communications that you submit obligation to offer such benefit to you or any other user in connection with any past, present or future request under any circumstances whatsoever. You also agree to receive other electronic communications from us, such as newsletters about new features and content of services, special offers, promotional announcements, and customer surveys. If you no longer wish to receive certain non-transactional communications by email, please contact Customer Service at 1 (877) -353-6630, click the "Unsubscribe" link contained in any email or any other link that indicates that you would like to be removed from the future, similar non-transactional communications.

Section 7: INTELLECTUAL PROPERTY

A. Brusa Property. The "Brusa TV" services, including any content made available in connection with your access to and use of our Services, are protected by national, international copyright laws, trade secrets, trademarks and other intellectual property laws. "Brusa Television", "Brusa" and "Brusa TV" are trademarks of BRUSA TV., E Brusa TV. And its affiliates have patents that apply to our Services.

B. End User License Agreement. Our sites, applications and other software and technologies are developed by or for us and are designed to allow the provision of certain content through Permitted Devices. Our sites, applications and other software and technologies may vary according to Permitted Device, operating system or other medium and their functionality may also differ between Permitted Devices. BY USING ANY OF OUR SERVICES, YOU ACKNOWLEDGE AND ACCEPT OUR END USER LICENSE AGREEMENT (IE, OUR EULA) AND RECEIVE NO ADDITIONAL WARNING OR PROMOTION, UPDATED VERSIONS OF OUR SITES, APPLICATIONS, AND OTHER SOFTWARE AND TECHNOLOGIES, INCLUDING RELATED THIRD PARTIES - PART OF THE SOFTWARE. IF YOU DO NOT ACCEPT THESE TERMS AND CONDITIONS ESTABLISHED IN OUR EULA, THEN NOT USE ANY OF OUR SERVICES.

C. Statement of Complaints. If you have a reasonable belief that your protected works or otherwise have been reproduced or distributed in a way that constitutes copyright infringement or is aware of any content available in connection with the Services that you may be violating, violating or your rights or the rights of the other party, then notify us immediately by sending us a written statement at the address of the notice set forth in Section 11.B. below, which written statement should present the maximum of details available, including, at a minimum: (i) your name; (ii) your address; (iii) your member account number (if any); and (iv) a clear and detailed statement of the applicable copyright infringement concern and / or related complaints or by clicking on the "DMCA Policy" link at www. brusa.tv/terms-of-use/ and informing us of your claim and other information as instructed.

D. Notice against piracy and infringement. Receiving any portion of the Services without paying for them, and / or any direct or indirect act or intent to engage or assist in any interception, reception, display or other unauthorized transmission or access to any portion of our Services is a violation of various US federal and state laws and these Terms of Use. Penalties for violating applicable laws may include imprisonment awards and civil damages of up to $ 110,000 per violation. Section 605 (e) 4 of Title 47 of the United States Code makes it a federal offense to modify your device or our Services to receive encrypted (encrypted) television programs without paying for the necessary signatures (for example, subscription services). TV BRUSA DOES NOT TAKE ANY RESPONSIBILITY OR ANY OTHERWISE ASSURING THE PERFORMANCE OF ANY DEVICE, INCLUDING THE CONTINUOUS COMPATIBILITY OF THE DEVICE (OR ITS OPERATING SYSTEM) WITH ANY OUR SERVICES, OR ANY INTERNET CONNECTION, INCLUDING ITS SPEED, BROADWAY, OR COMPATIBILITY WITH ANY BRUSA TV DEVICE OR SERVICE. PLEASE DO NOT MAKE ANY PROMISE ON THE NAME OF ANY THIRD PARTY, INCLUDING ANY OTHER CONTRIBUTORS, AND YOU ACKNOWLEDGE AND AGREE THAT YOU WERE NOT RELIED ON ANY PROMISE MADE BY US RELATED PARTIES OR THE PRODUCTS AND SERVICES PROVIDED BY THEM. The disclaimers set forth in these Terms of Use are expressly applicable to any hyperlinked terms incorporated herein, including any Promotional Terms, Privacy Policy and EULA, and including the software contained in our Services and your use of such software. We do not warrant that any problems, errors or other defects or failures in or related to the software or our Services will be corrected. BRUSA TV MAY RECOMMEND CERTAIN INTERNET CONNECTION LEVELS FOR USE WITH CERTAIN SERVICES; PROVIDED, however, that you agree and understand that BRUSA TV shall have no LIABILITY FOR YOUR INTERNET CONNECTIVITY AND TV BRUSA DOES NOT WARRANT OR WARRANT THE AVAILABILITY OR PERFORMANCE OF ANY INTERNET CONNECTIVITY, INCLUDING SPEED, BANDWIDTH, COMPATIBILITY, SUFFICIENCY, EQUIPMENT , OR DELIVERY OF ANY INTERNET CONNECTION OR THAT ANY CERTAIN INTERNET CONNECTIVITY WILL EXTEND OUR SERVICE (S). PLEASE, BE AWARE THAT SOME OF OUR SERVICES MAY REQUIRE THE USE OF ADDITIONAL DATA, AND WHAT COSTS, FEES OR OTHER AMOUNTS THAT MUST BE PAID BY YOU AS A RESULT OF ANY INCREASE IN USE (FOR ANY USE OF DATA) IN THE CONNECTION WITH THE SERVICES WILL BE YOUR SOLE RESPONSIBILITY. TV BRUSA CAN RECOMMEND OR READ THE NAMES OF CERTAIN DEVICES ALLOWED FOR USE WITH CERTAIN SERVICES, BUT YOU ACCEPT AND UNDERSTAND THAT BRUSA TV DOES NOT TAKE ANY LIABILITY FOR THAT AND BRUSA TV DOES NOT WARRANT THE PERFORMANCE OF ANY DEVICE OR WARRANT THAT THAT DEVICE (OR THE APPLICABLE OPERATING SYSTEM OR VERSION) WILL BE (OR REMAIN) COMPATIBLE WITH ANY OF OUR SERVICES. YOU MAY ONLY USE OUR SERVICES ON DEVICES ALLOWED. WE HEREBY DISCLAIM, AND YOU AGREE THAT WE HAVE NO OBLIGATION TO REPLACE OR SUPPLEMENT ANY SERVICE, SERVICE PACKAGE, OR PORTION OF ANY SERVICES (S) THAT WE CHANGE. WE ARE NOT MANDATORY AND HAVE NO RIGHTS AND PLEASE WAIVE ANY LAW, ANY CLAIM, REFUND, PRICE ADJUSTMENT, OR ANY OTHER DISCOUNT, COMPENSATION OR RECOMMENDATION OF ANY AMOUNT PAID BY YOU TO RECEIVE SUBSTITUTION, SUPPLEMENTARY OR ALTERNATIVE SERVICES, SERVICES PACKAGES AND / OR SERVICES POINTS AS A RESULT OF ANY CHANGE.F. NOR A T V BRUSA nor any other CONTRIBUTOR ASSUMES ANY LIABILITY, AND SHALL NOT BE LIABLE FOR ANY DAMAGES OR VIRUSES THAT MAY BE INFECTED, CORRUPT OR ANY OTHER HARM FROM ANY PROPERTY OR PROPERTY OF ANY THIRD PARTY, INCLUDING ITS SOFTWARE, DEVICE OR OTHER HARDWARE. NO WARNING OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM BRUSA TV OR OTHER CONTRIBUTORS, OR YOUR MEMBER ACCOUNT OR THE USE OF THE SERVICES, CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS OF USE.

Section 9: LIMITATION OF LIABILITY.

Indirect damages. YOU EXPRESSLY UNDERSTAND AND AGREE THAT WITHOUT WARRANTY, NOR ANY OTHER CONTRIBUTOR SHALL BE LIABLE FOR ANY INDIRECT OR INDIRECT DAMAGES (EXCEPT, SPECIAL, CONSEQUENTIAL, PUNITIVE, EXEMPLARY OR OTHER INDIRECT DAMAGES, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, EVEN IF BRUSA TV OR ANY OTHER CONTRIBUTORS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) ARISING OUT OF OR OTHERWISE ARISING DIRECTLY OR INDIRECTLY FROM: (i) OF OUR SERVICES OF ANY USE; (ii) ACTIONS, OMISSIONS AND OTHER ACTIVITIES UNDER YOUR MEMBERS ACCOUNT (INCLUDING USED UNAUTHORIZED USE BY US); (iii) THE PERFORMANCE OR NON PERFORMANCE OF OUR SERVICES; OR (iv) THE INSTALLATION, MAINTENANCE, REMOVAL OR TECHNICAL SUPPORT OF OUR SERVICES, EVEN IF SUCH DAMAGES RESULT FROM THE NEGLIGENCE OR GROSS NEGLIGENCE OF BRUSA TV OR OTHER CONTRIBUTORS. Force majeure. NO PURCHASER OR ANY OTHER CONTRIBUTOR SHALL BE LIABLE FOR ANY FAILURE TO CARRY OUT ANY CAUSE OR RESULTS OF ANY OTHER ACT OF GOD, FIRE, EARTHQUAKES, FLOODS, POWER OR TECHNICAL FAILURE, SERVER, INTERNET, SATELLITE OR UPLINK FAIL, ACTS OF ANY ORGAN GOVERNMENTAL, OR ANY OTHER CAUSE BEYOND OUR REASONABLE CONTROL. Limitation of liability. IN ADDITION TO ANY OTHER LIMITATIONS SET FORTH IN THIS TERMS OF USE, OR THE TV BRUSA OR OTHER CONTRIBUTORS WILL BE LIABLE FOR ANY ADDITION, DISPOSAL, REPLACEMENT, ALTERATION, INTERRUPTION, CHANGE AND / OR DISPOSAL ON ANY SERVICE OR FOR ANY DELAY, TO AVOID DOUBLE INCLUDING: (i) IF SUCH ADDITION, DISPOSAL, REARREGAMENTO, ALTERATION, INTERRUPTION, CHANGE AND / OR DISPOSAL OR ATRASÃO ARE attuned A TERMINATION OR ACCESS THE SUSPENSION TV BRUSA OF ALL OR ANY PART OF OUR SERVICES FOR ANY REASON ANY; (ii) THE RELOCATION OF ALL OR ANY PORTION OF OUR SERVICES TO DIFFERENT SERVERS (S); (Iii) ANY ADDITION, DISPOSAL, REARREGAMENTO, ALTERATION, INTERRUPTION, CHANGE AND / OR DISPOSAL IN FEATURES AND / OR FUNCTIONALITY AVAILABLE WITH YOUR DEVICES PERMITTED OR OUR SERVICES; (iv) ANY SOFTWARE OR OTHER DOWNLOADS STARTED BY US OR OUR EMPLOYEES; OR (v) QUESTIONS RESULTING FROM YOUR INTERNET DEVICE OR CONNECTION, INCLUDING NOT, BY THE ENTIRE BAND. PLEASE, NONE OF THE BRUSA TV, ITS SUPPLIERS, SUPPLIERS OF SUPPLIERS OR SERVICE PROVIDERS, OR ANY OF ITS OR THIRD PARTY LICENSORS BE LIABLE FOR ANY ADDITION, APPLICATION, REPLACEMENT, ALTERATION, INTERRUPTION, CHANGE AND / OR ELIMINATION OF OR FOR ANY DEVICE (S), TO AVOID DOUBTS, INCLUDING TO SWITCH OFF SOFTWARE, CHARACTERISTICS AND / OR FUNCTIONALITY. Limitation of direct damage. EXCEPT AS SPECIFICALLY AND EXPRESSLY SET FORTH IN SECTION 11, THE TOTAL MAXIMUM LIABILITY OF ANY BRUSA TELEVISION AND ALL CLAIMS UNDER OR IN CONNECTION WITH EACH ONE: (i) ACCOUNT MEMBERS INCLUDING ALL USERS AUTHORIZED THAT lower (IF MORE THAN 1 is PERMITTED BY USA), or (ii) YOU ONLY IF NOT AN AUTHORIZED USER ON ANY ACCOUNT MEMBER iS BOUND TO RIDE LIKE THE AGGREGATE FEES THAT WERE PAID BY YOU UNDER THESE TERMS OF USE DURING THE 6 MONTHS BEFORE APPLICABLE CLAIM, OR IF DURING THE FIRST 6 MONTHS OF ACCESS OR ANY TERMS OF USE against TAXES STILL PAYABLE BY YOU UNDER SUCH TERMS OF USE DURING THE FIRST 6 MONTHS OF SUCH TERMS OF USE. Applicability. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. AGREEMENTS, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU, BUT ONLY TO THE EXTENT, SUCH LIMITATIONS ARE EXPRESSLY DISCLAIMED BY APPLICABLE LAW (S). SIGNATURE OF ANY PACKAGE REGARDING THE BRUSA PLATFORM FOR A PHYSICAL PERSON IS NOT ALLOWED THAT ITS CONTENT WILL BE DISPLAYED IN A PUBLIC OR COMMON AREA OR ANY OPEN TO THE PUBLIC IN GENERAL. G. THE SIGNATURE STUDY FOR THE ACCESS OF FOUR AUTHORIZED DEVICES WHEREAS THE SIMULTANEOUS STREAMING FLOW IS LIMITED TO TWO LOGINS OF THE SAME SUBSCRIBER.

Section 10: INDEMNIFICATION

You agree to indemnify, defend and hold Brusa TV and its parents and affiliates, each of you and your current and future media providers, device providers, business partners, service providers, licensors, contractors, subcontractors, authorized dealers authorized subsidiaries, directors, members, managers, employees, agents, employees and other Users, and each of their respective assigns, heirs, successors and legal representatives (the "Protected Group") are harmless from, against, and with respect to any and all actions, claims, disputes or demands, including reasonable attorneys' fees.
